From the point of view of the Islamic Penal Code, the existence of duress in the crime of adultery causes the punishment to be aggravated and Had of death penalty for the duresser (adulterer) is established. Duress to adultery is possible both for a woman and, according to a more correct opinion, for a man. However, the third duresser cannot be sentenced to the punishment of adultery, and there is also is dagreement in punishing him as an accessory in adultery. In English criminal law, the legislator in the Sexual Offences Act 2003 has accepted the criminal title of "rape" only against someone who has not consented to sexual intercourse at all. In Egyptian law, rape also has been subject to punishments such as imprisonment with hard labor and even life imprisonment and execution, under the amendments of the Penal Code in 1999 and 2014. The use of violence, unconsciousness or deception of the victim are among the presumptions in which the lack of consent of the victim is presumed. In general, by examining the legal system of the three countries, it seems that, despite the criminalization of rape in all three countries, the approach of the Iranian legislator to the duresser and raper, which is derived from Islamic jurisprudence, is more decisive and subject to the harder sanction.
