ارزیابی سیاست کیفری نظام حقوقی ایران و عراق در قبال جرم افترا

چکیده

حفظ حریم حیثیت و شخصیت معنوی افراد،در تعادل با مصالح عمومی فراگیر چون آزادی بیان از جمله چالش‌های نظام‌های کیفری معاصر به شمار می‌آید. جرم افترا، به مثابه عرصه بروز این تعارض، در قوانین ایران و عراق ،علیرغم خاستگاه فقهی مشترک ،در قالب سیاست‌های تقنینی متمایزی بازتاب یافته است.در این پژوهش با روش توصیفی-تحلیلی و رویکرد تطبیقی، یافته‌ها نشان می‌دهد در حقوق ایران، جرم افترا ساختاری دو گانه دارد: از یک سو قذف به عنوان جرم حدی، مشمول مجازات حدی بوده و از سوی دیگر، افترای تعزیری به دو نوع قولی و عملی تقسیم می شود که هرکدام مجازات جداگانه ای داشته و عمدتاً غیرحبسی می باشند.در مقابل، نظام عراق با تفکیک افترای شخصی از مشروع (اداری و قضایی)، اشتراط «علنیت»، پیش‌بینی طیف مجازات‌های سلسله‌مراتبی و تصریح موارد اباحه، سیاستی دیگر ارائه داده است.در حقوق ایران نیز همانند عراق، اصل بر عدم تعقیب شاکی به اتهام افترا صرفا به دلیل عدم اثبات ادعا است ( اصل سی و چهارم قانون اساسی و رویه قضایی مستقر ) و نمایندگان مجلس در اجرای وظایف نمایندگی از مصونیت قضایی برخوردارند ( اصل هشتاد و ششم قانون اساسی ). اما هر دو نظام با چالش‌هایی روبرو هستند؛ نظام عراقی از جمله با ابهام در تفسیر «واقعه مستوجب تحقیر» و نظام ایرانی با عدم شفافیت در موارد اباحه و احتمال محدود شدن غیرضروری فضای نقد. این مقاله در نهایت، با پرهیز از ترجیح مطلق یک نظام و با نگاهی انتقادی به هر دو، پیشنهادهایی بومی‌سازی شده و مستدل برای اصلاح سیاست تقنینی ایران، ارائه می‌نماید.

Evaluation of the criminal policy of the Iranian and Iraqi legal systems regarding the crime of defamation

چکیده [English]

Protecting the dignity and spiritual personality of individuals, in balance with overarching public interests such as freedom of expression, is one of the challenges of contemporary criminal systems. The crime of defamation, as an area of ​​this conflict, has been reflected in the laws of Iran and Iraq, despite their common jurisprudential origin, in the form of distinct legislative policies. In this study, using a descriptive-analytical method and a comparative approach, the findings show that in Iranian law, the crime of defamation has a dual structure: on the one hand, slander as a hadd crime is subject to hadd punishment, and on the other hand, ta'ziri defamation is divided into two types, verbal and practical, each of which has a separate punishment and is mainly non-custodial. In contrast, the Iraqi system has presented a different policy by separating personal defamation from legitimate (administrative and judicial) defamation, requiring "publicity", predicting a range of hierarchical penalties, and specifying obscenity cases. In Iranian law, like Iraq, the principle of not prosecuting a plaintiff on charges of defamation is simply due to the lack of proof of the claim (Article 34 of the Constitution and established judicial practice), and members of parliament enjoy judicial immunity in the performance of their representative duties (Article 86 of the Constitution). However, both systems face challenges; the Iraqi system, including ambiguity in the interpretation of “insulting events,” and the Iranian system, with a lack of transparency in cases of obscenity and the possibility of unnecessarily limiting the space for criticism. Finally, this article, by avoiding absolute preference for one system and taking a critical look at both, presents localized and reasoned proposals for reforming Iran’s legislative policy.
